ATLVL — Terms of Service

These Terms of Service ("Terms") govern your use of the ATLVL mobile application (the "App") operated by ATLVL ("we", "us", "our"). By creating an account or using the App you agree to these Terms. If you do not agree, do not use the App.

1. The Service

ATLVL is an AI-powered coaching app that generates personalized, adaptive plans for goals you define. The App provides AI-generated content, task scheduling, gamification, and optional push notifications to support your progress.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

• You may create an account using email (magic link), Google, or Apple sign-in.
• You are responsible for maintaining the security of your account credentials.
• You may delete your account at any time from the App's profile settings. Deletion permanently removes all your data within 30 days.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Circumvent freemium limits, rate limits, or other technical restrictions.
• Submit content that is harmful, abusive, or violates the rights of others.
• Use automated tools (bots, scrapers) to access the App or its APIs.
• Impersonate another person or misrepresent your identity.

5. AI-Generated Content

• Plans, tasks, micro-content, and coach messages are generated by AI (Anthropic Claude) and are not professional advice. They do not replace medical, legal, financial, or other professional guidance.
• Physical skill plans include safety disclaimers. You assume all risk when performing physical activities suggested by the App.
• AI output may occasionally be inaccurate, incomplete, or inappropriate. Use your own judgment and report problematic content via the in-app Report button.

6. Subscriptions & Payments

• Free tier: 2 active goals, 2 coach personas, core features.
• Premium tier: Unlimited goals, all 5 personas, priority plan generation.
• Subscriptions are billed through the Google Play Store or Apple App Store. Prices are displayed before purchase. Billing, refunds, and cancellations are governed by the respective store's terms.
• You can cancel your subscription at any time through your device's store settings. Cancellation takes effect at the end of the current billing period.

7. Intellectual Property

• The App, its design, code, and branding are owned by ATLVL. You may not copy, modify, or redistribute them.
• Content generated for your goals (plans, tasks, micro-content) is yours to use personally. You may share your celebration cards and stats freely.
• You retain ownership of any text you submit (goal titles, notes, Brain Dump entries).

8. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what data we collect and how we use it.

9. Service Availability

• We aim to keep the App available but do not guarantee uninterrupted service. Maintenance, updates, or external factors may cause temporary downtime.
• The App requires an internet connection. Offline access is limited to viewing cached task cards.
• We may modify, suspend, or discontinue features at any time with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by law, ATLVL and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the App.

Our total liability for any claim relating to the App is limited to the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using the App at any time and delete your account. Upon termination, your right to use the App ceases immediately.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the most recent revision. If changes are material, we will notify you via the App or email. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which ATLVL operates. Any disputes will be resolved in the courts of that jurisdiction.
